Please read these Terms and Conditions carefully before using this website or engaging any of Pensara's services. By accessing the website or booking a service, you confirm that you have read, understood, and agree to be bound by these terms.

1. Definitions

• "Agreement" means these Terms and Conditions and any supplementary documents referenced herein.
• "Service" means any information session, document organisation support, or workplace education programme offered by Pensara.
• "User" / "You" means any individual or organisation that accesses this website or engages a Service.
• "We / Us / Our" means Pensara, operating from 99 Rama IX Road, Huai Khwang, Bangkok 10310, Thailand.
• "Content" means all materials, written summaries, session notes, checklists, and other documents produced by Pensara.

2. Acceptance of Terms

By using this website or booking a Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are booking on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

3. Description of Services

Pensara provides the following services in Thailand:

• Retirement Readiness Information Sessions — plain-language group or individual sessions covering general pension system structure, terminology, and signposting to official resources (฿3,500 per session).
• Document Organisation & Checklist Support — practical assistance structuring personal retirement-related paperwork (฿9,500 per package).
• Workplace Retirement Education Programme (B2B) — a structured informational programme for employers supporting staff in later career stages (฿34,000 per programme).

Services are provided in English and are primarily available in Bangkok. Remote or other arrangements may be discussed on a case-by-case basis.

4. User Responsibilities

When using this website or attending a Service, you agree to:

• Provide accurate and complete information when making an enquiry or booking
• Use the website and Content for lawful purposes only
• Not reproduce, distribute, or commercialise any Content without prior written permission from Pensara
• Not attempt to interfere with the operation of the website
• Not seek or expect personal financial, legal, or investment advice from Pensara or its facilitators

5. Scope of Services — Important Notice

All Pensara services are purely informational and educational. We do not provide personal financial advice, investment recommendations, legal advice, or any form of regulated financial services. Nothing communicated during a session, in a written summary, or through this website constitutes advice on your personal financial or legal situation. You should consult a licensed financial adviser or qualified legal professional for personal guidance.

6. Intellectual Property

All Content produced by Pensara — including session materials, printed summaries, checklists, and written documents — is the intellectual property of Pensara. You are granted a limited, non-exclusive, non-transferable licence to use Content for your own personal or internal organisational use only. You may not reproduce, publish, or distribute Content without written permission.

7. Payment Terms

All prices are stated in Thai Baht (฿) and are inclusive of applicable taxes unless otherwise stated. Payment is due prior to or at the time of service delivery unless a separate invoice arrangement has been agreed in writing. We accept bank transfer and other payment methods as communicated at the time of booking. Payments are non-refundable except as described in Section 8.

8. Cancellation and Refunds

Individual Sessions and Document Support

• Cancellations made more than 5 business days before the scheduled appointment: full refund.
• Cancellations made 2–5 business days before: 50% refund.
• Cancellations made less than 2 business days before or non-attendance: no refund.

Workplace Programmes

• Cancellations made more than 10 business days before commencement: full refund less any incurred design costs, to be communicated in writing.
• Cancellations made within 10 business days: no refund of the programme fee.

Pensara reserves the right to reschedule sessions due to circumstances beyond our control. In such cases, a full refund or rescheduled date will be offered.

9. Confidentiality

Personal information and documents shared with Pensara during a service engagement are treated as confidential. We will not disclose your personal information to third parties except as required by law or as described in our Privacy Policy.

10. Disclaimers

Services and website Content are provided on an "as is" basis. While we take care to keep session materials accurate and up to date, we make no representations about the completeness, accuracy, or currency of general information regarding pension systems or related matters. Pension rules and official processes can change; always verify current details with the relevant official body.

11. Limitation of Liability

To the fullest extent permitted by Thai law, Pensara's total liability to you arising from or in connection with any Service shall not exceed the amount paid for that Service. We shall not be liable for any indirect, consequential, or incidental loss or damage arising from your use of the website or attendance at a session.

12. Indemnification

You agree to indemnify and hold harmless Pensara and its staff from any claims, losses, or damages arising from your breach of these Terms, your use of Content in a manner not authorised here, or any misrepresentation made by you in connection with a booking.

13. Termination

Either party may terminate a service engagement by giving written notice. If Pensara terminates an engagement without cause before it begins, a full refund will be provided. If you terminate, refund terms in Section 8 apply. Provisions relating to intellectual property, confidentiality, disclaimers, and limitation of liability survive termination.

14. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from these Terms or a service engagement should first be raised with us directly at [email protected]. We will make reasonable efforts to resolve disputes informally within 30 days. If a dispute cannot be resolved informally, it shall be referred to the competent courts in Bangkok, Thailand.

15. General Provisions

• Entire agreement — these Terms, together with any booking confirmation, constitute the entire agreement between you and Pensara for the relevant Service.
• Severability — if any provision is found unenforceable, the remaining provisions remain in full effect.
• Waiver — failure to enforce any provision does not constitute a waiver of that provision.
• Assignment — you may not assign your rights under these Terms without our written consent.
• Notices — written notices may be sent by email to the addresses set out in these Terms.

16. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. Continued use of the website or engagement of our services after changes are posted constitutes acceptance of the revised Terms.
